Un horchatero valenciano gana un juicio a Lidl por infracción de patente

La multinacional copió un utensilio para hacer bebidas vegetales. Intentó que le quitaran la patente a Chufamix SL con una denuncia que ahora se ha vuelto en su contra
El horchatero e inventor valenciano Andoni Monforte ha ganado un juicio a LIDL en Alemania por comercializar un utensilio para hacer bebidas vegetales que es una copia de su Vegan Milker -de la empresa Chufamix SL-, que está patentada. La historia es bien curiosa y es la de un pez pequeño que se come, o más bien, se defiende, del grande.
La Vegan Milker es un aparato pensado para elaborar horchata y otras bebidas vegetales que ha calado en el mundo vegetariano. Según datos de la empresa, se han vendido más de 60.000 desde su lanzamiento en 2013 y está presente en más de 40 países como Alemania, Australia, Bolivia, Japón, Reino Unido o México.
El primer año facturó 54.000 euros; en 2016 llegó a 241.000 euros y, en 2017, entró en un ciclo de pérdidas por la copia del que no se ha recuperado hasta 2019, cuando ha vuelto a generar 40.000 euros de beneficios.
Distribuidores le contactaron indignados porque había visto la Vegan Milker más barata en LIDL
La Oficina Europea de Patentes le concedió la patente en junio de 2017. Un mes después, Monforte explica que un distribuidor francés le contactó, indignado, porque había visto que se vendía la Vegan Milker en un supermercado de LIDL por menos dinero. Incluso la madre del inventor le llamó para felicitarle pensando que había llegado a un acuerdo con la marca alemana después de verlo en un anuncio en televisión.
La diferencia de precio radica, según ha denunciado Monforte, en la calidad de los materiales: plástico de menor calidad, un 50% menos acero inoxidable en el filtro y “nula inversión en I+D” porque el producto “ya estaba inventado”. Además, la Vegan Milker está fabricada en España y Francia, mientras que la copia está hecha en China.
Entonces, el inventor valenciano remitió un requerimiento amistoso al CEO de la multinacional alemana, Dieter Schwarz, para que retirara su copia. “LIDL hizo caso omiso, manteniendo sus campañas de venta en Europa”, sostiene.
“Nos fotocopiaron hasta los dibujos del manual de instrucciones. En vez de disimular poniendo soja o almendras como ejemplo de semillas que el invento puede transformar en bebidas vegetales, su departamento de marketing en Alemania reprodujo las mismas chufas valencianas que nosotros teníamos. Lo más sorprendente es que LIDL sigue negando que se trata de un plagio de manual”, lamenta Monforte.
Casi tres años esperando el juicio en España
Ante el silencio de LIDL, la empresa Chufamix SL interpuso una querella por delito contra la propiedad industrial e intelectual en Moncada en noviembre de 2017, que fue admitida a trámite. En ella están siendo investigadas las división española de la multinacional, así como la holandesa y la alemana en su versión online por la venta a distancia del producto.
Se considera que el delito se ha cometido en España si el utensilio se ha comprado aquí (en la siguiente imagen, a la derecha, se ve un anuncio en La Vanguardia de la tienda online de LIDL Alemania, visto desde un hogar español, donde se podía comprar uno de los aparatos).
Durante la instrucción, Monforte revela que la Oficina Española de Patentes y Marcas y la sección de falsificaciones de la Policía Nacional emitieron a petición del juez instructor sendos informes que dictaminaban que LIDL “había reproducido de forma fidedigna e irrefutable todas las características protegidas por la patente”.
Sin embargo, la fiscalía y el juez instructor que inicialmente declararon que un juzgado valenciano era competente para instruir el caso, “dos años después cambian de opinión inhibiéndose a favor de los juzgados de Cerdanyola del Vallés (Barcelona), donde LIDL tiene su sede, quedando el proceso estancado en un limbo que la pandemia no ha hecho más que acentuar”.
LIDL demanda al inventor y le toca indemnizarle
La respuesta de LIDL no se hizo esperar. La marca española de la multinacional presentó una denuncia en el Tribunal de lo mercantil, y la división alemana LIDL Digital International GmbH, presentó dos en el Tribunal Federal de Patentes de Alemania. En ellas solicitaban la nulidad de la patente de la Vegan Milker en sus respectivos países, y la primera alemana, lo hacía por “pérdidas”.
La estrategia de la distribuidora alemana se ha vuelto, de momento, en su contra. El pasado 15 de mayo se celebró el primer juicio en la Audiencia Provincial de Mannheim y el 19 de junio los tres jueces de la Sala 7ª de lo Civil del tribunal emitieron la sentencia de 23 páginas. En ella desestiman la demanda de LIDL y, además, le condenan por haber infringido la patente del inventor valenciano.
Concretamente, en la sentencia, a la que ha tenido acceso La Vanguardia, se declarara que la demandante -LIDL- debe restituir a la demandada -Chufamix SL- “los daños y perjuicios que le han sido ocasionados desde el 28 de julio de 2017”. Además, “se condena a la multinacional a pagarle 2.636,90 euros junto con intereses del 5% sobre el interés legal a contar desde el 31 de julio de 2019”. Igualmente, se imponen a LIDL los costes del procedimiento judicial.

Monforte lamenta que “mientras que tres años después, en España el juicio sigue paralizado, en Alemania” se ha resuelto “tan solo nueve meses después” de que LIDL interpusiera la demanda. “Esta sentencia, junto al informe de la Oficina Española de Patentes y Marcas en España, puede marcar la senda del resto de juicios”, ha augurado el inventor.
“Lucrarte de una idea patentada ajena perjudicando a una pequeña empresa va en contra de la ley, te llames como te llames. Demandarla tres veces aprovechando su condición de pequeña empresa, de startup, denota además una falta de ética tremenda. Confiamos plenamente en que la justicia alemana y española sabrán aclarar lo sucedido y poner a cada cual en su sitio”, ha valorado Monforte.
